Terms of Service

Welcome to SignalMail. These Terms of Service ("Terms") govern your access to and use of the SignalMail application, website at getsignalmail.com, and related services (together, the "Service"). The Service is operated by SignalMail ("SignalMail", "we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

1. The Service

SignalMail is a cold-outreach and email-signals platform. It lets you connect your own email mailboxes (such as Gmail, Outlook/Microsoft 365, or an SMTP/IMAP account), import contacts, build campaigns and follow-up sequences, send messages through your connected mailboxes, and measure engagement signals such as opens, clicks, and replies. The Service may also offer AI-assisted features, such as reply classification and follow-up drafting.

SignalMail is a sending and analytics tool. You decide who to contact, what to send, and when. You are solely responsible for your campaigns and their compliance with the law.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your password and two-factor credentials secure, and for all activity that occurs under your account and your team's workspaces. Notify us promptly at [email protected] if you suspect unauthorized use.

3. Plans, Billing, and Trials

The Service is offered on subscription plans (such as Starter, Growth, and Agency) with the features and usage limits described at getsignalmail.com/pricing. New accounts may receive a time-limited free trial that does not require a payment method. We may change plans, features, and pricing on a prospective basis; we will give reasonable notice of material changes.

Payments are processed by our Merchant of Record, Lemon Squeezy, who acts as the reseller of subscriptions and handles checkout, payment collection, applicable taxes, and invoicing. Your purchase is also subject to Lemon Squeezy's terms. We do not store your full payment card details.

Subscriptions renew automatically each billing period until cancelled. You may cancel at any time through your billing settings or the customer portal; cancellation takes effect at the end of the current paid period. Except where required by law, fees are non-refundable. If a payment fails or a subscription lapses, access to paid features may be reduced or suspended.

4. Acceptable Use

You agree to use the Service only for lawful outreach and in compliance with all applicable laws and regulations, including anti-spam and data-protection laws such as the US CAN-SPAM Act, Canada's CASL, the EU/UK GDPR, and the ePrivacy rules, as they apply to you and your recipients. In particular, you agree that:

  • You have a lawful basis to contact every recipient you import or email, and you will maintain records of that basis where the law requires it. SignalMail does not provide, sell, or rent contact lists.
  • You will not send unlawful spam. You will use accurate "From", "Reply-To", and routing information, will not use deceptive subject lines or headers, and will identify the message as an outreach communication where required.
  • You will honor opt-outs. You will include a working unsubscribe mechanism where required, and you will promptly stop contacting anyone who unsubscribes or asks you to stop. The Service provides unsubscribe and suppression tooling to help you do this.
  • You will not send prohibited content, including material that is unlawful, fraudulent, deceptive, harassing, hateful, sexually exploitative, infringing, malware-laden, or that promotes illegal goods or services.
  • You will respect sending limits and deliverability safeguards. You will not attempt to evade rate limits, sending caps, suppression lists, bounce/complaint handling, or other technical controls.
  • You will not abuse the platform, including by reverse-engineering it, probing or breaching its security, scraping it, overloading its infrastructure, reselling access except as permitted under an Agency plan, or using it to build a competing product.

We may suspend or terminate accounts, pause sending, or remove content that we reasonably believe violates this section, generates excessive bounces or spam complaints, or threatens the deliverability, security, or integrity of the Service or other users.

5. Your Content and Data

"Your Content" includes the contacts, company records, message templates, campaigns, and other data you upload or create in the Service, together with the email content you send and the engagement data generated by your campaigns. As between you and SignalMail, you own Your Content.

You grant us a limited, non-exclusive license to host, process, transmit, and display Your Content solely to operate and provide the Service to you (for example, to render templates, send messages through your mailboxes, track engagement, and produce reports). Where Your Content includes personal data of your recipients, you act as the data controller and SignalMail acts as your processor; our handling of that data is described in the Privacy Policy.

You are responsible for the accuracy, quality, and legality of Your Content and for having the rights and consents necessary to provide it to us.

6. Connected Mailboxes

When you connect a mailbox, you authorize SignalMail to access that account on your behalf — to send messages you schedule and to read message metadata and content as needed to detect replies, bounces, and out-of-office responses. Access is granted through the provider's authorization flow (for example, Google or Microsoft OAuth), and stored credentials are encrypted at rest. You may disconnect a mailbox at any time, which revokes our ongoing access.

Your use of a connected mailbox must comply with that provider's terms (including Google API Services and Microsoft terms) and any sending or volume limits the provider imposes. You are responsible for the standing and reputation of your own mailboxes and sending domains.

7. AI Features

Some features use third-party AI models to classify replies or draft suggested follow-ups. AI output may be inaccurate, incomplete, or unsuitable, and is provided as a suggestion only. You are responsible for reviewing any AI-generated content before you send it and for the final message. AI-assisted classification does not override decisions you make manually.

8. Service Availability

We work to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular deliverability, open, reply, or conversion rate will be achieved — those depend on factors outside our control, including your lists, content, domains, and the receiving mail systems. We may modify, suspend, or discontinue features, and may perform maintenance, with or without notice.

9. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by SignalMail and protected by intellectual-property laws. These Terms grant you a limited, non-transferable, revocable right to use the Service during your subscription; they do not transfer any ownership to you. "SignalMail" and our logos are our marks and may not be used without permission, except where an Agency plan expressly allows white-label use under our guidelines.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, SignalMail disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, SignalMail and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or deliverability, arising out of or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless SignalMail and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your campaigns and messages, your use of connected mailboxes, or your breach of these Terms or of any applicable law — including any claim brought by a recipient or regulator in connection with messages you send through the Service.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk. On termination, your right to use the Service ends. We may delete Your Content after a reasonable period, as described in the Privacy Policy; export your data before closing your account if you need it.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and may notify you in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of [the jurisdiction in which the SignalMail operator is established], without regard to its conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where mandatory local law gives you other rights.
